Generally three years to file
Washington typically allows three years from the date of injury. Claims involving a city, county, or state agency carry shorter notice requirements — sometimes far shorter.
Partial fault doesn't bar recovery
Washington applies pure comparative fault. Even if the injured person bears some responsibility, recovery is still possible — reduced by their share.
Future damages are recoverable
Future medical care, future lost earnings, and future pain and suffering are all part of a claim. They have to be proven, which is why the expert work matters so much.
